Terms of Use
1. Operators and contact
Cesena Remembers is operated by co-developers Lorenzo Ostolani and Luca Bazzocchi. They manage the service and are identified as joint controllers in the Privacy Notice. The public Google Play developer name is OstoDev. Contact: [email protected].
2. The service
The app provides cultural and historical information about Cesena, maps, guided tours, location-based features, quizzes, XP, achievements, leaderboards, user profiles, friend requests and push notifications. Features may change across versions. The current app does not offer in-app purchases or advertisements.
3. Acceptance
Users must be able to read these Terms and the Privacy Notice before using the service. Acceptance of these Terms is distinct from consent to personal-data processing. The Privacy Notice informs users about processing and is not, by itself, a request for consent. Users who do not accept these Terms must not use the service.
4. Minimum age
The service is reserved for people who have reached the age of 14. Before Google Sign-In, users must accept these Terms, acknowledge that they have read the Privacy Notice and declare that they are at least 14. If the required confirmations are not selected, sign-in and registration cannot proceed. Under-14s may not register or use the service; no parental-consent registration route is offered. The age statement is self-declared and is not documentary age verification.
In Italy, Article 2-quinquies of Legislative Decree 196/2003 concerns consent to data processing for directly offered information-society services where consent is the legal basis; it does not automatically confer full contractual capacity.
5. Accounts and security
Account features use Google Sign-In and Firebase Authentication. Users must use an account lawfully available to them, choose an appropriate username and not impersonate others. Accounts are personal and must not be sold, transferred or shared to obtain advantages. Users should report suspected account compromise to the project contact. Users may delete their account in app settings or follow the account deletion instructions.
6. Profiles and social features
Public profiles and the global leaderboard can be viewed by any authenticated account, including accounts belonging to minors. They may show display name, username, avatar, XP, friend count and completed-tour count. Detailed statistics are restricted to the account owner and reciprocal friends under the app's access rules. Do not use your full name, school, date of birth, address, phone, email or other identifying information in your username or display name. Use a nickname that does not identify you in real life.
7. Acceptable use
Users must comply with applicable law and respect other users. It is prohibited to access accounts or systems without authorisation, bypass security controls, manipulate XP or rankings, interfere with service availability, use bots to gain unfair advantages, impersonate others, harass users, spam friend requests, distribute malware or infringe third-party rights. Reports may be sent to [email protected].
8. GPS, maps and route safety
Map and route features may use device location when permission is granted and the in-app GPS preference is enabled. During an active tour, the app automatically refreshes the route to the current stop and sends the device's current coordinates and the destination coordinates to Mapbox Directions whenever the location changes by approximately 40–45 metres or the destination changes. This is automatic and does not require a manual request for each update. Maps and routes may be inaccurate or outdated; follow road signs, official instructions and local safety rules. Do not use the app while driving or where it creates a distraction.
9. Quizzes and automated content
Some quizzes are generated or supported by language models using historical fact sheets maintained by the project. Automated content may contain errors or omissions and is provided for cultural and educational entertainment, not as an official historical source or professional advice. The quiz backend uses HTTPS/TLS at https://pascal.ispascalcomandini.it:8000. The app does not send Firebase UID, email or password to the quiz API; the server receives the source IP and data required to generate the quiz.
10. Intellectual property
Software, interface, graphics, original texts, trademarks and other materials are protected by applicable intellectual-property laws and belong to their respective authors or rights holders under law and valid agreements. Users receive a personal, limited, non-exclusive, non-transferable and revocable licence to use the app for personal, non-commercial purposes. Third-party libraries, map data, fonts and SDKs remain subject to their own licences.
11. Third-party services
The app depends on Google Sign-In and Firebase, Google Play Integrity, GroqCloud, Mapbox, CARTO, Stadia Maps, Esri/ArcGIS, Cloudflare, Google Fonts, GitHub and Google Play. Their services are governed by their own terms and privacy notices. Personal-data processing is described in the Privacy Notice.
12. Availability and changes
The service is provided according to its technical availability. Maintenance, network issues and third-party outages may occur. Features may be updated, modified or discontinued for technical, security, legal or organisational reasons. Significant changes will be communicated appropriately and, where required, users will be asked to accept updated Terms.
13. Suspension and termination
For violations, security risks, abuse, legal requirements or technical reasons, the operators may take proportionate measures, including limiting features or suspending an account. Where reasonably possible, users will be informed of the measure and its reasons, unless notice is prohibited or would compromise security or an investigation. Users may stop using the service and request account deletion at any time.
14. Liability and mandatory rights
The operators take reasonable measures to maintain a functional and secure service but cannot guarantee uninterrupted operation or the absence of errors or vulnerabilities. Nothing in these Terms excludes or limits liability that cannot be excluded by law or mandatory consumer rights.
15. Privacy
Personal-data processing is described in the Privacy Notice. These Terms do not replace the Privacy Notice and do not, by themselves, constitute consent to data processing. Where specific consent is required, it is requested separately and may be withdrawn as provided by law.
16. Governing law
These Terms are governed by Italian law and applicable European Union law. Mandatory user and consumer rights and applicable jurisdiction rules remain unaffected.
